OVERVIEW

These Terms of Service govern your use of the MEMENTAIL online store and your purchase of products from us. By visiting the store or placing an order, you agree to these terms. If you do not agree, please do not use the store.

ONLINE STORE TERMS

You must be legally able to enter into a binding agreement in your place of residence. You may not use our products or services for any unlawful or unauthorized purpose, and you must not introduce malicious code or interfere with the operation or security of the store.

PRODUCTS AND CUSTOMIZATION

MEMENTAIL products are handcrafted and may be made to order using customer-supplied photographs, descriptions, and customization details. Small variations in colour, texture, shape, scale, and finish are natural characteristics of handmade work and are not defects. Screen settings and lighting can also affect how colours appear.

You are responsible for providing clear, accurate reference materials and order details. By submitting photographs or other content, you confirm that you have the right to use and share that content for fulfilment of your order.

ORDERS AND PAYMENT

All orders are subject to acceptance and availability. We may refuse, limit, or cancel an order where information is inaccurate, payment cannot be authorized, fraud is suspected, a product is unavailable, or fulfilment is not reasonably possible. If we cancel an order after payment, we will refund the amount paid for the cancelled item.

Prices, promotions, product descriptions, and availability may change without notice. Applicable taxes, shipping charges, customs duties, or import fees may be added where required.

ORDER CHANGES AND CANCELLATIONS

Because customized products may enter production shortly after an order is placed, requests to change or cancel an order should be made through our Contact page within 24 hours. We will try to accommodate the request, but changes or cancellations are not guaranteed once production has begun.

SHIPPING AND DELIVERY

Production and delivery estimates are estimates only and are not guaranteed delivery dates. Delays can arise from customization, carrier operations, customs, weather, peak periods, or events outside our reasonable control. Please review our Shipping Policy for more information.

RETURNS AND REFUNDS

Returns, replacements, and refunds are governed by our Refund Policy. Customized or personalized products are generally final sale except where they arrive damaged, defective, or materially different from the confirmed order, subject to applicable consumer law.

INTELLECTUAL PROPERTY

The store and its content, including text, graphics, photographs, branding, designs, and software, are owned by or licensed to MEMENTAIL and are protected by applicable intellectual-property laws. You may use the store for personal, non-commercial shopping purposes only. You may not copy, reproduce, distribute, sell, or exploit store content without prior written permission.

THIRD-PARTY SERVICES AND LINKS

The store may rely on or link to third-party services, payment providers, carriers, applications, or websites. We are not responsible for third-party content, availability, security, or practices. Your use of third-party services may be subject to separate terms.

ACCURACY AND AVAILABILITY

We aim to keep store information accurate, but errors or omissions may occur. We may correct information, update content, or cancel affected orders where necessary. We do not guarantee that the store will always be uninterrupted, secure, or error-free.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, MEMENTAIL will not be liable for indirect, incidental, special, or consequential loss arising from use of the store or products. Nothing in these terms excludes rights or remedies that cannot legally be excluded under applicable consumer-protection law.

These terms are governed by the applicable laws of Canada and the province or territory in which MEMENTAIL operates, without limiting any mandatory consumer rights that apply in your place of residence.
